TERMS OF SERVICE

§ 1 General Provisions

  1. These terms and conditions, hereinafter referred to as the “Terms,” specify the exact rules for using the services provided by Jakub Wojtysiak artistic tattoo at ul. ks. Czesława Klimasa, no. 43B, 50-515 Wrocław hereinafter referred to as the “Studio.”
  2. The Studio provides services during selected hours and days.
  3. Studio clients are obliged to familiarize themselves with the Terms before booking an appointment for services at the studio. Proceeding with the selected service indicates acceptance of these Terms, without the need for the Client’s signature.
  4. The Terms, along with the Price List and Service Description, constitute a contract for the provision of services.

§ 2 Definitions

  1. Client – refers to a natural person, an adult who is 18 years of age or older and has full legal capacity.
  2. Minor – a client who is under 18 years of age and uses the Studio’s services with verbal or written consent from a parent/legal guardian.
  3. Terms – refers to these Terms prepared by the Service Provider.
  4. Studio – refers to the Service Provider providing services at a given location at the address provided.
  5. Service – refers to a service/procedure provided by the Service Provider to the Client.

§ 3 Client Obligations

  1. A Studio Client is an adult or a minor with the consent of a legal guardian. In the case of a minor, the Studio is entitled to view the appropriate consent from the legal guardian before the appointment and to refuse to provide the Service in the absence of such consent.
  2. The Client is obliged to provide information about their health condition if it is necessary to make a decision about performing a specific service and to sign a declaration about the truthfulness of the provided information by completing and signing the required documentation.
  3. Each Client is familiar with the indications, contraindications, side effects, and post-procedure recommendations, and by proceeding with the Procedure, they are fully aware of them and accept them. Confirmation is the informed consent for the procedure signed by the client.
  4. Each time a Procedure is performed again, the Client should confirm the current state of health and information provided or update medical information, especially contraindications, each time.
  5. The Client is obliged to immediately notify the person performing the procedure of any deterioration in their health condition during the Service.
  6. Clients should arrive for scheduled appointments without accompanying persons.
  7. The Client should arrive at the Studio at most 10 minutes before the start of the Service.
  8. The Client should inform the Studio by phone with appropriate advance notice of any potential delay.
  9. The Studio allows for a Client’s delay of up to a maximum of 30 minutes, after which time the service will be canceled or shortened. Each case of delay is considered individually by the Studio.
  10. In the case of cancellations by the Client later than allowed by these Terms or not showing up for a scheduled appointment without cancellation within the specified time more than once, the Studio is entitled to refuse to provide or reserve another appointment for the given Client.

§ 4 Price List

  1. The Studio provides services listed in the current service price list available at the studio reception.
  2. Before choosing a Service, the Client can familiarize themselves with its description, duration, and price.

§ 5 Appointment Reservations

  1. The Studio maintains reservations and records appointments through: reception and the Studio’s social media.
  2. For the purposes of these Terms, “Force Majeure” means any event beyond the Studio’s control, including but not limited to a random event, epidemic and pandemic, war, insurrection, riots, civil unrest, acts of terrorism, fire, explosion, flood, theft or failure of essential equipment, deliberate damage affecting the operation of the Studio, strike, lock-out, weather conditions, acts and regulations of state or local government bodies, sudden disconnection of utilities in the Studio. The Studio will not be liable to the Client for failure to perform any obligations under these Terms to the extent that it is caused by the occurrence of Force Majeure. In such a situation, the Client will receive the opportunity to book another available date.
  3. To reserve an appointment, a reservation deposit is required, which is deducted from the final price. In the case of concluding a distance contract, as well as in the Studio, it is possible to withdraw from the contract within 14 calendar days from the moment of making the payment. After this period, cancellation results in the loss of the reservation deposit. If the designated service date is less than 14 days away, then in the event of cancellation, the deposit is non-refundable.
  4. Up to 14 days before the scheduled appointment, it is possible to change the service date. After this period, each change involves paying a new deposit.

§ 6 Payments

  1. The Client is obliged to pay for the services performed immediately after their completion.
  2. The Studio provides the following payment methods:
    • Blik
    • Bank transfer
  3. The Service Provider reserves the right to introduce temporary promotions, gift vouchers, or service packages. The rules regarding their purchase and duration will be regulated in a separate appendix to these Terms.
  4. Promotions cannot be combined.

§ 7 Hygiene and Safety – Studio Standards

  1. The Studio declares that all employees are appropriately trained and experienced, have current health examinations, and perform Services at the highest level and with due diligence.
  2. Before proceeding with the Service, the employee is obliged to properly prepare their workstation and ensure appropriate disinfection performed before each Client.
  3. The employee is obliged to perform the procedure correctly in accordance with applicable procedures and professional standards, while maintaining appropriate hygienic and sanitary conditions and health and safety regulations, as well as fire safety regulations.
  4. The Studio uses disposable applicators and disinfected accessories and tools.
  5. Only disinfection preparations approved for use and required by the sanitary inspectorate, in accordance with applicable regulations and standards, are used in the Studio.
  6. The Studio, caring for the hygiene and safety of clients with the utmost care and observance of hygienic and sanitary procedures, uses appropriate certified preparations for disinfection.
  7. In the event of injuring a Client during the Procedure, the Procedure is immediately interrupted, the post-exposure procedure is activated, and the place of injury is immediately washed, disinfected, and secured with a sterile dressing appropriate to the scale of the injury. The interrupted Procedure is completed, if possible, after securing the injury site or at another time convenient for the client.

§ 8 Studio Obligations

  1. Before performing the Service, the Studio is obliged to:
    1. conduct an interview with the Client regarding their expectations and health condition and obtain from the Client a completed and signed consent for the procedure,
    2. to present to the Client any contraindications to performing the Service and any recommendations after the service,
    3. to inform the Client about the real effects of the procedure, the number of procedures needed to achieve the intended effect, about possible side effects or complications after the procedure, about preparations used for the procedure,
    4. to comply with the principles of hygiene and safety during the performance of Services in accordance with sanitary procedures, treatment procedures, and health and safety regulations,
    5. to take before and after photos for procedure documentation.
  2. The Studio reserves the right to make changes to the Terms for important reasons, that is, e.g.: changes in law, changes in payment methods, changes in the provision of services – to the extent that these changes affect the implementation of the provisions of these Terms. The new terms come into force on the day the changes are introduced. The Studio undertakes to inform all clients with reserved dates about changes in the Terms before the services are provided.
  3. In case of doubt regarding the safety of performing the procedure, the Studio reserves the right to refuse to perform the procedure.

§ 9 Complaints

  1. The Client has the right to submit a complaint regarding the Service.
  2. The Client should submit the complaint in person at the Studio on a complaint form.
  3. The complaint must contain the Client’s personal data enabling their identification and ensuring contact, a description of the reason for the complaint along with the scope of demands.
  4. For complaint purposes, photographic and/or video documentation concerning the reason for the complaint will be made.
  5. In all cases, the condition for considering the complaint is the personal appearance at the Studio. Complaints submitted by telephone, email, SMS, or through social media will not be considered.
  6. The Service Provider will consider the complaint within 14 days of its acceptance and will inform the Client in writing or by email to the provided contact details.
  7. After considering the complaint, the Client is obliged to sign a complaint protocol.

§ 10 Final Provisions

  1. Each Client has the right to view the Terms and price list.
  2. The current Studio Terms are displayed and available in the Studio in a visible and accessible place for Clients.
  3. For any damage to the Studio equipment by the Client, Clients are liable without limitation in accordance with Article 415 of the Civil Code. For damage caused by minors, their legal representatives are responsible.
  4. The Studio is not responsible for any items left in outer clothing or in the Studio, outside the places intended for their storage, in particular valuable items, bags, backpacks, and handbags, which the Client should keep with them.
  5. In the entire Studio, there is a complete ban on smoking and using tobacco and tobacco and nicotine products, including electronic cigarettes, as well as a complete ban on consuming alcoholic beverages and other types of stimulants and intoxicants.
  6. During the performance of the Service, the use of a telephone by the Client is prohibited, excluding random situations.
  7. It is forbidden to bring animals into the Studio.
  8. Any disputes arising from the provided Services should be resolved amicably in the first instance. In the event of failure to reach an agreement, disputes will be resolved by the court of general jurisdiction.
  9. If any of the provisions of these terms should be deemed invalid, contrary to the law, or unenforceable, it will be excluded from the provisions of these terms, which will continue to apply to the broadest extent permitted by law.

§ 11 Processing of Clients’ Personal Data

  1. By making a reservation at the Studio, the client agrees to the processing of their personal data for the purposes described below, in this paragraph.

  4. Clients’ personal data obtained in connection with the use of Studio services will be processed for the following purposes: for the purpose of communication with the client (receiving information about planned visits via mobile telephony and email) and for the purpose of performing the service.
  5. The legal basis for processing Clients’ data will be: granted consent, necessity to perform a contract or to take action at the Client’s request before concluding a contract, necessity to fulfill a legal obligation incumbent on the administrator, necessity for purposes resulting from legitimate interests pursued by the administrator, e.g., such as responding to Clients’ letters and requests.
  6. Clients’ data may be transferred to the following entities: processors (processing entities) in connection with activities commissioned by the Studio, entities authorized under the law, control and supervisory bodies, enforcement authorities, courier companies that will deliver parcels to Clients. Clients’ data will be transferred to a third country (e.g., USA) in connection with activities conducted on Facebook (clients contacting through the Studio’s fanpage on Facebook or Instagram).
  7. The period for processing Clients’ personal data depends on the purpose for which the data is processed. The period for which personal data will be stored is calculated based on the following criteria: laws that may oblige the Studio to process data for a specific period (e.g., data on invoices are kept for 5 years from the end of the last fiscal year), the period that is necessary to defend the interests of the Studio, and the period for which consent was granted.
  8. In addition, please be informed that Clients have the right to: request access to personal data concerning them, rectify their data, request the completion of incomplete personal data, including by submitting an additional statement, delete their data or limit their processing, object to further processing of their personal data, transfer their personal data. However, in exceptional situations, data cannot be deleted immediately. These are:
    • data that is necessary to implement the service and any complaint period,
    • data for which there are legal grounds to continue processing despite this,
    • data processed in accordance with other legal provisions.
  9. Clients have the right to withdraw their consent at any time. Withdrawal of consent does not affect the lawfulness of data processing that was carried out on the basis of the consent given before its withdrawal.
  10. In case of doubts as to the correctness of the processing of personal data by the Studio, Clients have the right to lodge a complaint with the supervisory authority. Please direct all correspondence regarding the processing of personal data to the Administrator with the subject “Personal Data” to the email address: arcadio777morales@gmail.com.
  11. The Client’s personal data is processed in accordance with the above content and for the purposes indicated in the above information clause, with which the Client also becomes familiar during their first visit to the Studio.
